Transcription: Signatures: J. W. VanAuken and John Mays } Nicholas his X Mark Warthan Declarant. On the same day personally
appeared J. W. VanAuken and John Mays persons who are well known to
me and whom I certify to be respectable and entitled to credit; and
they, being sworn according to law, declare that they were present
and say Nicholas Warthan sign his name to the above application;
that they are not near relatives of said applicant, and have no
interest in this claim nor in the prosecution thereof; that they are
residents of New Hampton in the county of Chickasaw and State of
Iowa; that they have been acquainted with said Nicholas Warthan and
his family and their pecuniary circumstances for that past ten
years; (4) that they know that he is (5) [Blank] of (6) [Blank] who
died on or about the [Blank] day of [Blank] A. D. 186 ; and that he
is the Father of said Emanuel Warthan who entered into the Military
Service of the United States and died as stated in his said
Declaration. That, as to said applicant having been wholly or in part supported by his said Son, and his contribution of his time, or labor or earnings towards his support, or supplying him with necessaries before his enlistment, and sending portions of his pay to him after his enlistment, the facts derived from the deponents' knowledge thereof and their acquaintance with said applicant and his family, are as follows: (See two Affidavits hereto attached.) VanAuken and John Mays I certify that the above declaration and affidavit of witnesses were sworn to and subscribed before me this Sixteenth day of July 1867, and that the contents thereof wre fully understood by them before the execution thereof, and that I have no interest in said Claim or in its prosecution. W. VanAuken who being first duly sworn according to law depose and say that they reside in New Hampton Chickasaw County and state of Iowa and that they know that Emanuel Warthan, who was a private in Co. "B" of the 3d Regiment of Minnesota Volunteers Infantry, sent portions of his pay to his father Nicholas Warthan, residing in New Hampton Chickasaw Co. Transcription: PDF Page 1: State of Iowa Chickasaw County - SS On this 7th day of July A.D. 1880 personally appeared before me Clerk of he District Court - a Court of record in and for said County. Henrietta Maria Warthan, widow of the late Nicholas Warthan who died in the month of July 12th day A.D. 1872, who being duly sworn says that she is the widow of said Nicholas Warthan, having never remarried, that she is the mother of Emanuel Warthan deceased late Private in Co "G" 3rd Regt Minnesota Volunteers - on whose account her said husband Nicholas Warthan filed a claim for Pension No. 150.605, July 30 1867 as appears by the enclosed letter from C. W. Seaton Acting Commissioner of Pensions dated Feby 23" 1872 addressed to J. W. Mitchell New Hampton, Iowa, and states that she is aged, almost totally deaf, and is infirm and crippled, and has been a cripple for about 20 years owing to a S??? injury to one of her hips by a fall down stairs and is in very indigent circumstances, and that for more than twenty years she has never been able to earn her living. That both herself and her husband were dependent upon their said son for support for many years before his enlistment in the said service of the United States [Stamp: "U.S. Pension Office July 16 1880"]

Warthan - she called herself 67 but stated that she was married in the year 1832 at the age of 23 years, which makes her over 70 years old -- E. C. Stebbins attorney PDF Page 2 - [Ph8901-001B.jpg] New Hampton Iowa July 12 1880 Sir: In the Pension Claim No. 150.605 of Nicholas Warthan father of Emanuel Warthan late private Co "G" 3rd Regiment Minnesota Infantry - I herewith file evidence of the death of said Nicholas Warthan and an Application of his widow Henrietta M. Warthan that she be made a substituted applicant in said claim of the said Nicholas Warthan deceased and that said case be reopened and pension granted to her as though the original claim had been filed by her in her name. Nicholas Warthan had no education at all, was extremely aged and had no one to look after his interest and was so poor that he ??? to have found no one who cared to pay much attention to his claim and so it was dropped during his lifetime, and since his death his widow has been so deaf, and so infirm and so poor that she could do nothing or ??? anything done in the case for her, Last week her son-in-law Nicholas Binder who has sheltered her for the past two years, but who is not able to support her (having 7 or 8 children 2 by a former marriage and 5-6 by his marriage with the said Susan Warthan) having small means and being in debt, and not wishing to send her to the County Poor House PDF Page 3 - [Ph8901-002A & B.jpg] brought her to my office, to see what could be done towards Procuring for her this Pension to which she is so justly en- titled and so richly deserving of. I got from her, with much difficulty, the enclosed statement, on account of her extreme deafness, poor old woman! She has seen pretty rough times and the prospect of going to the Poor- house seems a drop too much in her bitter cup - She says it wouldn't seem so hard for her to go if it was not for her deafness - and she knows her son-in-law is not able to support her - Her son Benjamin was never any depen- dence for his parents before his marriage and now 5 or 7 children and her daughter Mary Gardner has 13 or 15 children and both are very poor - from personal acquaintance and hearsay I have had a general knowledge of the family since the year 1861 and their indigent circumstances. Dr. U. M. Mix of New Hampton, treated the old lady when she was cared for by; the county and has been employ ed I think in the families of all his children and could make affiant as to their poverty if enough evidence is not already on file as to it enclosed find - Application aforesaid Affidavits of J. Transcription: In the matter of the Pension Claim No. 150.605 of Nicholas Warthan father of Emanuel Warthan late - Private - Co. "G" 3rd Minnesota Regiment - J. H. Powers of New Hampton, Iowa, being duly sworn, says: that he became acquainted with said Nicholas Warthan, Henrietta Mona Warthan his wife and their family, in the year 1857, and was at their house frequently where he first came to the County. They living at that time a couple of mile north of the present Village of New Hampton - that where he first knew them the said Nicholas Warthan was already an aged man (he was over 90 years old at the time of his death some 7 or 8 years ago, affiant does not remember the exact date) and unable to earn his subsistence by manual labor, could only perform a little light-labor, that his wife the said Henretta M. Warthan though many years his junior was a woman past middle life and not able to labor for the support of herself and husband - that their said son Emanuel Warthan was their dependence for support, that he was an industrious young man and labored for their support - soon after he first ??? said family until he enlisted into the service of the U.S. in 1864 - That his said son Benjamin a younger son, they placed no dependence upon, he was married Sept 7 1862 and has had a larger family and a hard struggle with family since his marriage - The youngest child Mary C. Warthan was married to Z. B. Gardner (usually called Babel Gardner) Sept 9 1860 and has a very large family and been always in exceedingly [start of second page] indigent circumstances - the other daughter Susan E. Warthan used generally to work out around as house servant to support herself. until her marriage to Nicholas Binder July 29, 1869. that they have also a large family, are in ??? circumstances and are not in a condition to support the said Henrietta M. Warthan widow of the late Nicholas Warthan and mother of the said Emanuel Warthan the deceased soldier aforesaid. That the said Henrietta Warthan is now aged and infirm and has been for many years a cripple, is ex- ceedingly deaf, and her eyesight - dimmed by age, and is in a state of absolute destitution, and deserving of a pension on account of her said son Emmanuel for he was her dependence for support. Morton being duly sworn says that he is 59 years old and was a resident of Chickasaw County, Iowa from 1856 to 1875 and personally knew said Henrietta M. Warthan and family and know that she was crippled and infirm and unable to earn her living, that here husband was an aged man and by reason of age and infirmity was unable to support her - that her sold and only dependence was her said son Emanuel Warthan from the time the said Warthan family came to Chickasaw Co. Iowa in the year 1856 or 1857 until the said Emanuel Warthan went into the army - That he has no interest in the prosecution of said claim for Pension and is present residence is Phillips Co. Jones being duly sworn deposes and says: that his is 47 years old and has been a resident of the Township of Dresden in said County and State ever since the year 1855 and his Post office address is Williamstown, Iowa. That he has been personally acquainted with said Henrietta M. Warthan for thirteen years last past and that during all of said period of time she has had no visible means of support and no one has been legally bound to support her, that he has been a township master for the past two years and during the time has procured for her from the County necessary clothing, the amount and value of same he does not now re- member. She is aged and infirm and unable to work to support herself, has not been able to support herself for the past thirteen years. That he is not in any way related to nor connected with said claimant and has no interest in the prosecution of said claimant

Weaklen being duly sworn says she is 31 years old and a resident of New Hampton Iowa and is the wife of a mechanic and her Pos office address is New Hampton, Ia Nine years ago last month she spent two weeks in the month of February at the house of her brother John Glass in the township of Dayton in said County and state and Mrs. Warthan who had gone there to do some knitting for the family was taken very sick, and affiant helped to take care of her, she was attended by a physician and was a great care, affiant does not remember how long she was sick there, she was wholly without means of support and ???, walked with a crutch before she was taken sick, was very deaf at the time - as affiant now remembers the county paid her board bill and for care while there - Affiant has been acquainted with her about sixteen years seeing her occasion ally each year, and knows that during
