Enclosed you will receive a Certificate, No. 183067, for
$300.00 payable to you as father of deceased
or to your cider, by any Paymaster of the U. S. Army,
being for pay due Emmanuel Warthan dec late private
in Captain Devereaux Company G, 3
Regiment of Minneapolis, for services from the 3d day
of June, 1864, when paid, to the 8 day
of Oct, 1864, time of his death, and Bounty
allowed by J R July 19, 1864. $240.

Sir,
I have the honor to acknowledge the receipt from your Office
of application for Pension No. 150.605, and to return it
herewith, with such information as is furnished by the files of this
Office.
It appears from the Rolls [unreadable] Office, that,
Emanuel Warthan was enrolled on the 27th
day of Feby, 1864, at St Paul i Co. the,
3 Regiment of Minn Volunteers, to
serve 3 years, or during the war, and mustered into
service as a Pvt on the 2nd day of March
1864, at St. Paul Minn, in Co. the, 3
Regiment of Minn Volunteers, to serve 3
years, or during the war.  ON the Muster Roll of Co. "G"
of that Regiment, for the months of Nov & Dec
1864, he is reported "absent without leave in Minn??? Dec 22, 64,
supposed to be dead," ?? ? Roll of Co. dated Sept 2, 65 ???
???"  Died in Chickasaw Co, Iowa Oct 8, 64 while on
furlough."

    Died at New Hampton, Chickasaw County, Iowa on or about 1 Oct 1864 due to chronic diarrhea contracted while in the service of the United States, and in the line of his duty . .

Dependent Father or Mother's Declaration for Army Pension. -- Printed at the TRIBUNE Co.'s Book and Job Office, 51 Clark Street, Chicago
State of Iowa Chickasaw County, }SS.
   On this 16th day of July 1867, personally appeared before me, the undersigned, Clerk of the District Court, in and for the County and State above named, which is a Court of Record, (1) Nicholas Warthan who being first duly sworn according to law, deposes and says that he resides at Dayton in the County of Chickasaw State of Iowa and is aged 82 years, and that he is the Father of (2) Emanuel Warthan who was a (3) Private in Company "B" of the 3d Regiment of Minnesota Volunters [sic] Infantry in the civil war of 1861-5, for suppression of the Rebellion against the United States Government.  That he said Son was mustered into the military service of the Untied States at Wabashaw, Minnesota on or about the 15 day of March A.D. 1864, and that he died at New Hampton in the County of Chickasaw and State of Iowa on or about the first day of October 1864, by reason of chronic Diarrhea contracted while while in the service of the United States, and in the line of his duty, and that he left no Widow, Child or Children or surviving him.  That he has not in any way been engaged in, or aided or abetted said Rebellion.  That he is not now in receipt of a Pension under any act of Congress, and that he makes this declaration for the purpose of being inscribed on the Army Pension List, under "An Act to grant Pensions," approved July 14, 1862, and the acts supplementary thereto, to commence on the [Blank] day of [Blank] 186_.  he requests that he be inscribed on the Roll of the D???? I?? Agency.  That Post Office Address is New Hampton County of Chickasaw State of Iowa, and he hereby constitutes and appoints Tucker & Sells Washington of D. C. his Attorney to prosecute this claim and procure a Pension Certificate.

   On the same day personally appeared J. W. VanAuken and John Mays persons who are well known to me and whom I certify to be respectable and entitled to credit; and they, being sworn according to law, declare that they were present and say Nicholas Warthan sign his name to the above application; that they are not near relatives of said applicant, and have no interest in this claim nor in the prosecution thereof; that they are residents of New Hampton in the county of Chickasaw and State of Iowa; that they have been acquainted with said Nicholas Warthan and his family and their pecuniary circumstances for that past ten years; (4) that they know that he is (5) [Blank] of (6) [Blank] who died on or about the [Blank] day of [Blank] A. D. 186 ; and that he is the Father of said Emanuel Warthan who entered into the Military Service of the United States and died as stated in his said Declaration.
That they knew the said Emanuel Warthan and that he died leaving no wife or child surviving him, and that his Father was supported mainly by the said Son, before and after his enlistment into said Military Service.  That said applicant's present means of support are as follows:  he has personal property, worth in our estimation Sixty Dollars, consisting of one cow and two two-year old heifers

That, as to said applicant having been wholly or in part supported by his said Son, and his contribution of his time, or labor or earnings towards his support, or supplying him with necessaries before his enlistment, and sending portions of his pay to him after his enlistment, the facts derived from the deponents' knowledge thereof and their acquaintance with said applicant and his family, are as follows:  (See two Affidavits hereto attached.)

I certify that the above declaration and affidavit of witnesses were sworn to and subscribed before me this Sixteenth day of July 1867, and that the contents thereof wre fully understood by them before the execution thereof, and that I have no interest in said Claim or in its prosecution.

and say that they reside in New Hampton
Chickasaw County and state of Iowa
and that they know that Emanuel
Warthan, who was a private in Co. "B"
of the 3d Regiment of Minnesota Volunteers
Infantry, sent portions of his pay
to his father Nicholas Warthan, residing
in New Hampton Chickasaw Co. Iowa,
while he was in the service, that
he expressed ?? ??? for his pay
to H. Gurling of New Hampton Chick??

On this  7th day of July
A.D. 1880 personally appeared before me
Clerk of he District Court - a Court of record
in and for said County. Henrietta Maria
Warthan, widow of the late Nicholas
Warthan who died in the month of July
12th day A.D. 1872, who being duly sworn says
that she is the widow of said Nicholas
Warthan, having never remarried, that
she is the mother of Emanuel Warthan
deceased late Private in Co "G" 3rd Regt
Minnesota Volunteers - on whose account
her said husband Nicholas Warthan filed
a claim for Pension No. 150.605, July 30
1867 as appears by the enclosed letter from
C. W. Seaton Acting Commissioner of Pensions
dated Feby 23" 1872 addressed to J. W. Mitchell
New Hampton, Iowa, and states that she
is aged, almost totally deaf, and is infirm
and crippled, and has been a cripple for
about 20 years owing to a S??? injury to one
of her hips by a fall down stairs and is in
very indigent circumstances, and that for
more than twenty years she has never been
able to earn her living.  That both herself
and her husband were dependent upon their said
son for support for many years before his
enlistment in the said service of the United States
[Stamp:  "U.S. Pension Office July 16 1880"]

That their other children who were surviving
at the time of the decease of their son [marked out]
son Emanuel Warthan towit:
Benjamin Warthan born 1839
Susan E. Warthan born 1841
Mary C. Warthan born 1846
are now living in Chickasaw County, Iowa,
are all married, all have large families
and are unable to support her.  The first and
last mentioned being in indigent circum
stances, sometimes having to receive aid from
the County or town in which they live.
That she has had no settled home for the
past 12 or 13 years, but has staid with
acquaintances a little while at a time
as it was convenient for them to keep
her except ??? on fit of sickness when the County paid a board bill of
about sixty dollars.  For the past 2 years has staid with her daughter Susan
and her clothing has been given to
her by different persons until the lat
year the County has furnished her clothing
After her son enlisted he sent home two
hundred dollars, as will appear by his
letter accompanying this application, from
La Cross, Wis, Mch 30" 1864, to be invested in a
little home from the parents of said Soldier as
therein stated, that they invested the same
in 40 acres of land, but the amount did not
pay for it in full and his back pay and bounty
which was procured for them after his
decease (the records at Washington D.C. will

show the amount, affiant does not know
how much it was) was also applied to the
payment of said 40 acres (and the support of the family
but it did not entirely pay it, so they sold it
and bought another place, but not being
abe to pay for it entirely, and not able
to carry on either place themselves, they sold it
and the proceeds were soon consumed for
their support, that when the said Emanuel
Warthan enlisted in the service of the U.S. the
said Nicholas Warthan and Henretta Warthan
his wife were living upon a portion of the
16th Section or School Section in New Hampton
Township, Chickasaw C. Iowa, from which he
had a contract but not being able to pay
for it was obliged to abandon or assign
it to some one else, that the said Emanuel
Warthan left his parents a couple of cows
and a pig when he left home for Minnesota
when he enlisted; that the above and ????
statements of money received from and on
account of the said Soldier after his enlist
ment and death and the above mentioned
personal property constitutes the sole and
only means of support of the said parents of
the said Emmanuel Warthan since his said
enlistment - that she therefore asks that
she be made a substituted applicant in
the said claim No. 150.605 of the said Nicholas

Warthan deceased now on file in the Pension
Office in Washington, D. C. before mentioned
and that said claim be reopened and Pension be granted to her
as though the original application had been
filed by her and in her name, that she
hereby appoints E. C. Stebbins of New Hampton
Iowa her true and lawful attorney to prose
cute this claim for her and her Post Office
address is Williamstown, Chickasaw Co. Iowa,

    This is to certify that the records of this office show that Emanuel Warthan late a Private in Company “G” of the third (3rd) Regiment of Minnesota Infantry Volunteers, was enlisted on the 27th day of February 1864, for the term of 3 years, was mustered into the Military Service of the United States on the 2nd day of March 1864 and that he died at his home in Iowa Oct 8  1864.

In the Pension Claim No. 150.605 of Nicholas
Warthan father of Emanuel Warthan late
private Co "G" 3rd Regiment Minnesota
Infantry - I herewith file evidence of the
death of said Nicholas Warthan and an
Application of his widow Henrietta M. Warthan
that she be made a substituted applicant in
said claim of the said Nicholas Warthan deceased
and that said case be reopened and pension
granted to her as though the original claim
had been filed by her in her name.
Nicholas Warthan had no education at all,
was extremely aged and had no one to look
after his interest and was so poor that he ???
to have found no one who cared to pay much
attention to his claim and so it was dropped
during his lifetime, and since his death his
widow has been so deaf, and so infirm
and so poor that she could do nothing or
??? anything done in the case for her,
Last week her son-in-law Nicholas Binder
who has sheltered her for the past two years,
but who is not able to support her (having
7 or 8 children  2 by a former marriage and 5-6
by his marriage with the said Susan Warthan)
having small means and being in debt, and not
wishing to send her to the County Poor House

brought her to my office, to see what
could be done towards Procuring for her
this Pension to which she is so justly en-
titled and so richly deserving of.  I got
from her, with much difficulty, the enclosed
statement, on account of her extreme deafness,
poor old woman!  She has seen pretty rough
times and the prospect of going to the Poor-
house seems a drop too much in her  bitter cup -
She says it wouldn't seem so hard for her to
go if it was not for her deafness - and she
knows her son-in-law is not able to support
her - Her son Benjamin was never any depen-
dence for his parents before his marriage and
now 5 or 7 children and her daughter
Mary Gardner has 13 or 15 children and both
are very poor - from personal acquaintance
and hearsay I have had a general knowledge
of the family since the year 1861 and their
indigent circumstances.  Dr. U. M. Mix of
New Hampton, treated the old lady when she
was cared for by; the county and has been employ
ed I think in the families of all his children
and could make affiant as to their poverty if
enough evidence is not already on file as to it
enclosed find - Application aforesaid  Affidavits of J. W.
Powers and John W. Mitchell.  a letter of Emanuel Warthan
dated Mch 30" 1864 & one from the Pension Department of Feby 23, 1872
and Certificate of Adjutant General of Minnesota.
For humanity's sake please give the matter your early attention

Emanuel Warthan deceased, John W.
Mitchell aged 39 years of New Hampton, Iowa, being
duly sworn says that he has been person-
ally acquainted with all of said parties
ever since he can remember, and knows
by personal knowledge that they the parents were
dependent upon their said son Emanuel
Warthan for support for years before
his enlistment and that said Emanuel Warthan
did support his parents up to the time
of his enlistment, that the said Nicholas
Warthan died on the 12th day of July AD
1872 in the Township of Washington in the
County of Chickasaw, State of Iowa and
was buried in the Catholic Cemetery in
the township of Utica in said County by
the side of his said son Emanuel Warthan, on
the 13" of July A.D. 1872, he, the said Mitchell
being personally present at the funeral
and burial - that he frequently sees the
said Henrietta M. Warthan and knows that
her situation as described in the accompa=
nying application is  true - that he was
at her house soon after the fall therein
referred to while she was still confined
to her bed and knows that she was bed=

ridden on account of aforesaid injury for weeks
and knows that she has ever since walking
only by the aid of a crutch or cane, that
he cannot remember the precise date of said
injury but should state that it was at least
20 years ago, and that prior thinks she
was not a rugged strong woman but was a
somewhat delicate health, and somewhat
lame from rheumatism or some other
cause unknown to affiant.  That ever since
his remembrance she has been so deaf
as to render conversation with her almost
an impossibility, it being total in one ear
and existing to a very great degree with the
other - That she is in very destitute cir=
cumstances, and is and has been since the
enlistment of her son Emanuel and for a
long time prior thereto wholly unfit to earn
her subsistence by manual labor, That
he has no interest in the prosecution of said
claim and his Post Office is New Hampton
Chickasaw Co. Iowa.

Warthan father of Emanuel Warthan late - Private -
Co. "G" 3rd Minnesota Regiment - J. H. Powers of
New Hampton, Iowa, being duly sworn, says:  that he
became acquainted with said Nicholas Warthan,
Henrietta Mona Warthan his wife and their family,
in the year 1857, and was at their house frequently
where he first came to the County.  They living at that
time a couple of mile north of the present Village of
New Hampton - that where he first knew them the
said Nicholas Warthan was already an aged man
(he was over 90 years old at the time of his death some
7 or 8 years ago, affiant does not remember the exact
date) and unable to earn his subsistence by manual
labor, could only perform a little light-labor, that
his wife the said Henretta M. Warthan though many
years his junior was a woman past middle life
and not able to labor for the support of herself and
husband - that their said son Emanuel Warthan was
their dependence for support, that he was an industrious
young man and labored for their support - soon after
he first ??? said family until he enlisted into the
service of the U.S. in 1864 - That his said son Benjamin
a younger son, they placed no dependence upon,
he was married Sept 7 1862 and has had a larger family
and a hard struggle with family since his marriage -
The youngest child Mary C. Warthan was married to
Z. B. Gardner (usually called Babel Gardner) Sept 9 1860
and has a very large family and been always in exceedingly

indigent circumstances - the other daughter
Susan E. Warthan used generally to work out
around as house servant to support herself.
until her marriage to Nicholas Binder July 29, 1869.
that they have also a large family, are in ???
circumstances and are not in a condition to support
the said Henrietta M. Warthan widow of the late
Nicholas Warthan and mother of the said Emanuel
Warthan the deceased soldier aforesaid.  That the
said Henrietta Warthan is now aged and infirm
and has been for many years a cripple, is ex-
ceedingly deaf, and her eyesight - dimmed by age,
and is in a state of absolute destitution, and
deserving of a pension on account of her said
son Emmanuel for he was her dependence for
support.  That he has no interest in said claim
for pension and his Post-Office address is
New Hampton, Chickasaw County Iowa

says, that he is 77 years old, and has been
acquainted with the said Henrietta M. Warthan
since his childhood, that the then Henrietta
Maria Mitchell
was married to the said
Nicholas Warthan on the 16th day of August
1832 at the house of the said Walter C. Mitchell at B???, Frederick County, Maryland
by Father McElroy of Fredericktown in the
State of Maryland - That he was present at the
marriage - that in the year 1837 the said
Walter C. Mitchell resided with his family and
the said Henrietta M. Warthan and Nicholas
Warthan, also resided at Somerset, Perry Co
Ohio and that Emanuel Warthan son of the
said Henrietta M. / Nicholas Warthan was
born at said place on the 30th day of April
A.D. 1837, and that ever after the said Henrietta
M. and Nicholas Warthan came to Chickasaw
County, Iowa in May A.D. 1856 they were
dependent for support upon their said son
Emanuel - that the said Walter C. Mitchell
came to Chickasaw County Iowa in May A.D.
1856 and had personal knowledge of the cir-
cumstances of the said Warthan family even

after they came to Chickasaw County and
knows that the said Emanuel remained unmarried
and was the dependence of his said parents for
support.  That about the year 1863 the said
Henrietta M. Warthan received an injury to one
of her hips by a fall and has ever since been

the year 1839 she has been almost totally
deaf - That ever after the said Nicholas
Warthan came to Chickasaw Co. he was unable
by reason of age and general feebleness to
earn his subsistence by manual labor
and he died July 12" 1872 at the age of
90 years to the best of affiants knowledge
and belief - That the present age of the

says that he is 59 years old and was a
resident of Chickasaw County, Iowa
from 1856 to 1875 and personally knew
said Henrietta M. Warthan and family
and know that she was crippled and infirm
and unable to earn her living, that here
husband was an aged man and by reason
of age and infirmity was unable to support
her - that her sold and only dependence was
her said son Emanuel Warthan from
the time the said Warthan family came
to Chickasaw Co. Iowa in the year 1856
or 1857 until the said Emanuel Warthan
went into the army -
That he has no interest in the prosecution
of said claim for Pension and is present
residence is Phillips Co. Kansas and he is
Postmaster at Jimtown, Kansas.

sworn deposes and says:  that his is 47 years
old and has been a resident of the Township
of Dresden in said County and State ever
since the year 1855 and his Post office
address is Williamstown, Iowa.  That he
has been personally acquainted with said
Henrietta M. Warthan for thirteen years
last past and that during all of said
period of time she has had no visible
means of support and no one has been
legally bound to support her, that
he has been a township master for the
past two years and during the time
has procured for her from the County
necessary clothing, the amount and
value of same he does not now re-
member.  She is aged and infirm and
unable to work to support herself, has
not been able to support herself for
the past thirteen years.  That he is not in
any way related to nor connected with
said claimant and has no interest in
the prosecution of said claimant

A. Weaklen being duly sworn says she is
31 years old and a resident of New Hampton
Iowa and is the wife of a mechanic and
her Pos office address is New Hampton, Ia
Nine years ago last month she spent two
weeks in the month of February at the
house of her brother John Glass in the
township of Dayton in said County and state
and Mrs. Warthan who had gone there
to do some knitting for the family was
taken very sick, and affiant helped to
take care of her, she was attended by a
physician and was a great care, affiant
does not remember how long she was
sick there, she was wholly without means
of support and ???, walked with a
crutch before she was taken sick, was
very deaf at the time - as affiant now
remembers the county paid her board bill
and for care while there -
Affiant has been acquainted with her
about sixteen years seeing her occasion
ally each year, and knows that during

all said period of time she has been
very deaf and a cripple and in destitute
circumstances.  She is not related to nor
connected with said claimant and has no
interest in the prosecution of said claim
She has read this affidavit and knows its

being duly sworn says:  that she is 44 years
old, that her residence has been Dresden
Township in said County and State for
18 years last past, that she is a
farmer's wife, that her Post office
address is Fredericksburg, Iowa: that
she has been acquainted with said claimant
for fourteen years last past:  that during
said period of time she has had no visible
means of support, and no one has been
legally bound to support her to affiants
knowledge, that she has been in destitute
circumstances all the while, and ???
years ago in very destitute circumstances
three years ago this coming Christmas

her, that affiant went to the township
masters with a list of articles that were
an absolute necessity to claimant and
procured an order to get said things
she purchased the necessaries enumerated

living during affiants acquaintance
with her. She has been severely sick
at different times requiring medical
care - Affiant is not related to nor
connected with claimant and has no
interest in the prosecution of said claim
She further states that she read this
affidavit and knew its contents before
she signed it.

meridian and do hereby convent with the said
Nicholas Warthan that we are lawfully signed a fee

Dated 5 Feb 1884 - State of Iowa – Chickasaw County

In Pension claim No. 285736 of Henrietta M Warthan mother of Emanuel Warthan late Private Co “G” 3rd Rgt. Minnesota Inf.  Claimant being duly sworn says that the name and relationships of her family in 1864 were as follows:

            Her husband Nicholas Warthan born June 10 1786

            Her son Emanuel Warthan born April 30, 183?

            Her son Benjamin P F Worthen born Aug 27 183? – Married in the year 1862

            Her daughter Susan E Warthan born Dec 12, 18?? – Who was single and worked out to support her

            Her daughter Mary C Warthan born May 24, 18?? – who was married in the year 1860 Basil Gardner and is now his wife

 

These were all the surviving members of her family in 1864; that no one has been legally bound to support her since the death of her said son Emanuel Warthan That since the death of her said son, her residence has been in the townships of New Hampton, Dayton, and Dresden in the County of Chickasaw, Iowa and her Post Office address has been New Hampton, Iowa, and Williamstown, IO.  That for several years before her said Son’s death her husband was by reason of age and physical infirmities unable [page 6] to support her and was never able to support her after his death.

 

That she has never remarried since the death of her said husband.

 

That at time of Emanuel’s death in 1864] she lived on a farm in New Hampton Township (Town 95, Range No 12) purchased from one Moon (as a transcript from the record of said County will show) which was purchased with Emanuel’s money that is, partly paid for and a mortgage given to one Catharine Baldwin to get money to finish paying for the place – the place was deeded to Claimants husband and he being unable to pay off the mortgage, sold the place and bought 40 acres in Dayton Township (Town 95 Range 13) in said Co and State (which transcript from the Recorder of County will show) – he sold the place for a span of horses, wagon and harness and a small amount in money.  After leaving this last named farm claimant and her husband staid with her son Benjamin two or three months at which place her said husband died.  She can not, give an account of all the money that she and her husband had on her son’s account, but it was but a little and it was all that they [page 7] had for their support – The house that they had to live in was small and from, one of them a log house with sod roof the other a small board house, they had barely the necessities of life – Claimant sometimes did a little knitting for some of the neighbors and received a few trifles in return, like some little articles of warring apparel or material to make some – since her husbands death she has spent the time in Dres. Township mostly, being away only a few weeks at a time occasionally, has staid with her daughter Susan who was married in summer of 1869 and has lived in Dresden Township in said County – and State since – She cannot furnish testimony of her husband’s employers as to his income in 1864 and subsequently for the reason that he was unable to work and earn any thing – she cannot furnish testimony any farther than she has (except ??? a transcript of County records will show what property they had in 1864 and subsequent either real or personal, she has had no property either real or personal since the death of her husband.  The former statement she made explains all other points she ??? ???

acquainted with said Emanuel Warthan,
that said Emanuel Warthan was a
single man, that he left no widow
nor child surviving him, for the
reason that he was never married.
Affiant has no interest in the prosecution
of said Pension claim.
